§1 Scope
(1) These General Terms and Conditions apply to all contracts for mobile vehicle cleaning services between washmee GmbH (hereinafter “washmee mobile”) and its customers. (2) Customers within the meaning of these GTC are both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB). (3) Deviating conditions of the customer do not become part of the contract unless washmee mobile expressly agrees to their validity in writing.
§2 Subject Matter of the Contract
(1) washmee mobile provides mobile exterior and interior cleaning of motor vehicles in accordance with the service description selected during the booking process. (2) The following are not included: • Engine washing • Repair services • Smart Repair • Technical or mechanical interventions (3) The specific scope of services is determined by the service selected during the booking process.
§3 Conclusion of Contract
(1) Bookings are made exclusively digitally through the washmee mobile platform. (2) By completing the digital payment process, the customer submits a binding offer to conclude a service contract. (3) The contract is concluded upon electronic booking confirmation.
§4 Performance / Location Requirements
(1) Cleaning is carried out exclusively: • on private property • on a solid, liquid-impermeable surface • using a special containment mat • with complete collection of dirt and wastewater (2) The wastewater is properly disposed of in a washmee mobile stationary facility through a legally compliant separator system. (3) The customer is obliged to ensure that: • the explicit consent of the property owner has been obtained, • sufficient working space (at least approx. 2 meters around the vehicle) is available, • there are no public-law or actual obstacles, • they are authorized to commission the cleaning, and • they are the registered keeper of the vehicle or have been expressly authorized by the registered keeper/owner to have the mobile vehicle cleaning carried out. (4) If these conditions are not met upon arrival, washmee mobile is entitled to refuse or abort the performance. In this case, there is no entitlement to a refund.
§5 Service Area
(1) Services are provided exclusively in the postal code areas enabled in the booking system. (2) The service area can be dynamically adjusted. A booking is only possible if the address is technically enabled.
§6 Prices and Payment
(1) All prices are inclusive of statutory VAT for consumers. (2) Payment is made exclusively digitally in advance. (3) No separate travel fee is charged.
§7 Cancellation and No-Show
(1) Cancellation more than 24 hours before the appointment: 100% refund. (2) Cancellation within 24 hours before the appointment: 50% refund. (3) Cancellation within 12 hours before the appointment: no refund. (4) If the customer does not appear, washmee mobile will wait a maximum of 15 minutes. The appointment is then considered a “No-Show”. No refund will be made. (5) If the location conditions are not met contrary to the customer’s confirmation, there is no entitlement to a refund. (6) If washmee mobile cancels the appointment for internal reasons (e.g., illness, technical defects), a full refund will be made. (7) The booking fee is displayed prior to payment and is non-refundable in all cases.
§8 Customer Obligations
The customer undertakes to: • provide truthful information, • report any pre-existing damage before commencement, • remove personal belongings, • disclose sensitive paintwork, wraps, or coatings.
§9 Liability
(1) washmee mobile is liable without limitation in cases of intent, gross negligence, and for damages resulting from injury to life, limb, or health. (2) In cases of simple negligence, washmee mobile is only liable for breach of essential contractual obligations. Liability is limited to the typical, foreseeable damage and a maximum of the respective order value. (3) Liability for pre-existing damage, hidden defects, age-related material fatigue, or third-party prior work is excluded. (4) washmee mobile accepts no liability for damages due to: • refinished or repaired surfaces • stone chips or paint delamination • matte or special paintwork • wraps or coatings of unknown quality • ceramic coatings • loosely attached vehicle parts (5) Indirect damages, loss of use, loss of profit, or consequential damages are excluded to the extent permitted by law. (6) Commercial liability insurance exists.
§10 Documentation
(1) washmee mobile is entitled to take photos and videos of the vehicle before and after the service. (2) These serve as evidence and documentation of pre-existing damage.
§11 Use of Photo and Video Material (Marketing)
(1) washmee mobile is entitled to use anonymized recordings made during the service for marketing purposes. (2) No license plates, addresses, or identifiable personal data will be published. (3) The customer may object to such use at any time for the future.
§12 Force Majeure
(1) In cases of force majeure (e.g., extreme weather, official orders, technical failures), washmee mobile is entitled to reschedule appointments or withdraw from the contract. (2) Claims for damages are excluded. (3) Payments already made will be refunded or credited at the discretion of washmee mobile.
§13 Place of Jurisdiction
For entrepreneurs, the place of jurisdiction is Mannheim. For consumers, the statutory regulations apply.
§14 Severability Clause
Should any provision of these GTC be invalid, the validity of the remaining provisions shall not be affected.
Right of Withdrawal (for Consumers)
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (washmee GmbH, Theodor-Heuss-Anlage 12, 68165 Mannheim, email: info@washmee.de) by means of a clear statement of your decision to withdraw. To meet the withdrawal deadline, it is sufficient to send your notification before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days.
Premature Expiry of the Right of Withdrawal
For services, your right of withdrawal expires prematurely if: • you have expressly agreed that we may begin performance before the withdrawal period has expired, and • you have confirmed that you will lose your right of withdrawal upon complete performance of the contract.
